We warrant that ActionWare will substantially conform to the published specifications and to the documentation, provided that ActionWare is used on the computer hardware and with the operating system for which it is designed.
License: We retain the ownership of the ActionWare software. Your copy is licensed to you for use under the conditions specified in the executed License Agreement.
The following uses are permitted. You may:
Use ActionWare only on the current model of IBM AS/400 as indicated in the License Agreement between Licensee and ActionWare.
Use ActionWare for internal purposes only and only on the IBM AS/400 computer that you designate as the Designated Machine, or on a backup AS/400 if the Designated Machine is not functional.
Make any modifications to your ActionWare system, where source code has been licensed. You must retain an unmodified copy of ActionWare as it was delivered.
The following uses are not permitted. You may not: make copies of the program disks or backup copies of the program disks except as outlined in this documentation. Rent, lease, distribute or sublicense the software or documentation.
The warranty and remedies set forth in the License Agreement are exclusive and in lieu of all others oral or written and express or implied. No ActionWare re-seller, distributor, agent, or employee is authorized to make modifications or additions to this warranty
Except as specifically provided in the License Agreement , we make no warranty or representation, either expressed or implied, with respect to this program or documentation, including their quality, performance, merchantability, or use for a particular purpose.
We retain all rights not expressly granted. Nothing in this documentation constitutes a waiver of our rights under US copyright law or any other Federal or state law.
We warrant that the CD media on which the program is distributed is free from defects in materials and workmanship.
We will replace defective media, or correct substantial program errors, at no charge. You must be able to demonstrate defects in your unmodified copy of ActionWare. Time spent on reported defects that result from a Licensee's error will be charged at our current rates.
Because computer hardware and programs are inherently complex and may not be completely free from errors, we strongly encourage you to back up your work on a regular basis. In no event will we be liable for direct, indirect, special, incidental, or consequential damages arising out of the use of or inability to use the program or documentation
